House Bill 3054, An Act Ensuring State Agencies are not Harmed by Long Term Contracts
This legislation amends the uniform procurement law of the Commonwealth, Chapter 30B, to protect the Commonwealth, vendors and, most importantly, taxpayers from the dangers of long term contracts. Long term contracts often harm either the vendor (who has locked in a short term price calculation over a long period) or the Commonwealth (who is subject to continual change orders/mark-ups throughout the life of a long term contract). In particular, the legislation provides that a governmental body may not enter into a contract for a period of time exceeding five consecutive years, including renewals. If an awarding authority determines it is in its best interests to have a contract for a period of longer than five years, including renewals, the awarding authority shall seek the written approval of the State Auditor before the issuance of any such request for proposals.
By requiring the Commonwealth to either re-bid contracts on a five year or less cycle or seek the State Auditor’s review, this legislation will reduce government spending while limiting vendor risk.
House Bill 762 / Senate Docket 917, An Act Relative to Increasing the Amount for Consideration by Small Claims Courts.
This legislation increases the jurisdictional amount that may be heard by a small claims court. The few matters that may be considered under the current $2,000 limit require companies to expend significant funds to pursue claims before the District Court. This not only costs both parties incur legal fees, but allows for meritorious claims to be abandoned due to the cost of recovery.
In particular, this legislation, and other similarly filed matters, amends Chapter 218 of the Mass. Gen. Laws to increase the jurisdictional amount to anywhere from $3,000 to $7,000. This type of legislation, which has been filed in the past, has not received consistent attention or support. Given the financial downturn of the Commonwealth, this measure will reduce legal costs associated with pursuing small claims – to the benefit of companies and, frankly, consumers alike.
Employee Free Choice Act The so-called Employee Free Choice Act better known as the Card Check Bill. This legislation which would overturn decades of settled labor law and give organized labor an unfair advantage in union organizing, at the expense of both employees and employers.
The Safer Alternatives Bill This bill proposes to extend the toxic reduction provisions of TURA from the manufacturing process into the end product. We are working with a team of businesses and associations to modify the Safer Alternatives Bill to be less invasive on our business members. Safer Alternatives (S2406, formerly H783 and S558), encourages a reduction in the presence of toxic chemicals in consumer products through a scientific process. The process identifies hazardous chemicals, how they are used, and - when it is cost-effective and feasible - requires a safer substance be used in the place of the dangerous chemical.
Unit Pricing Chapter 6: Section 115A. Unit pricing of packaged commodities; retail sale; regulations. This law is costly and puts Massachusetts businesses at a disadvantage.
