Overview of the Homestead Act

The Massachusetts Homestead Act is a law under which a homeowner is protected by an Estate of Homestead. A homestead estate provides limited protection of the value of the home, up to $500,000, against unsecured creditor claims.

In 2010, the Massachusetts Legislature passed Chapter 395 of the Acts of 2010, an Act Relative to the Estate of Homestead, to revise and replace the provisions of the Massachusetts homestead protection law, General Laws Chapter 188.
